Special conditions, what are they and why you should be careful?

A special condition is a condition that's inserted into the contract that is not one of the standard conditions in the contract. The reason you should be careful is because generally they'll favor the buyer or the seller depending on what party has inserted the condition. You should also be aware that poorly worded special conditions can make the contract ambiguous or difficult to enforce throughout the course of the conveyance.

It also might mean that the rights of the party who inserted the condition may not be the rights they really wanted in relation to those conditions. It is always best, where possible, to get a lawyer to draft your special conditions to make sure they are best suited for you and protect you in the way you want throughout the course of your conveyance.
